Planned lottery state treaty violates anti-trust and European law

(Hamburg, 08.06.2007) On 8th June 2006, OLG Dusseldorf confirmed the 23rd
August 2006 decision by the Federal Cartel Office, according to which the
Deutsche Lotto- und Totoblock (German Lottery and Toto Group) group treaty
violates EC law. Particularly the regional restrictions are obviously
unlawful.

The implementation of the prohibition of regionalisation mainly affects the
core statements within the planned gaming state treaty. The European
Commission had also already informed the German states directly in two
separate letters that the planned lottery state treaty violated fundamental
market freedoms allocated by the European Union and European anti-trust
laws. Now this has also been confirmed by the Oberlandesgericht (Higher
Regional Court), which has confirmed the current legal position where the
regionalism principle – the formal restriction of lotteries to their
relevant state – violates European anti-trust law.

Germans and EU citizens can take part in any lottery of a country,
regardless of where the people happen to be located. The national lottery
companies are not permitted to restrict acceptance of internet bets and
other lottery bets to those made by residents within their own countries.
