Online lottery brokerage allowed DGAP-News: Tipp24 SE / Key word(s): Legal Matter Online lottery brokerage allowed 03.03.2011 / 16:01 --------------------------------------------------------------------- Online lottery brokerage allowed * Advertising bans repealed * No permission required for brokerage (Hamburg, 3 March 2011) The online brokerage of state lotteries requires no permission. This was the verdict of the Administrative Court of Chemnitz on 3 March 2011. The ruling also states that advertising for lottery products is permitted. The court thus upheld in full the complaint brought by Tipp24 SE. The court also overruled the regionality principle, under which Germany's states decide at federal level on permissions for lottery brokerage and force brokers to submit lottery tickets only to the respective state lottery companies. This means that the brokerage of lottery products is once again possible, as in the time before the current State Treaty on Games of Chance (Glücksspiel-Staatsvertrag - GlüStV). Dr. Hans Cornehl, CEO of Tipp24 SE, states: 'This decision is a clear signal for Germany's politicians. Following the verdicts of the Administrative Courts of Berlin and Halle, a third court has now fully repealed key restrictions of the State Treaty on Games of Chance. A complete success for us. The Minister Presidents of all Germany's states should also take this decision into consideration.' Germany's state premiers are currently discussing a revised version of the GlüStV, which is expected to come into force in 2012. In September 2010, the European Court of Justice (ECJ) had declared Germany's gambling regulations as inapplicable due to a lack of coherence and consistency. The ECJ questioned the current reasoning for Germany's lottery monopoly, which cites the potential dangers of addiction. As a consequence, the Administrative Court of Halle surveyed all of Germany's guardianship courts and around 100 addiction clinics on the importance of lotteries with regard to gambling addiction. In his evaluation of the results, Prof. Dr. Stöver, Director of the Institute for Addiction Research at the University of Applied Science Frankfurt am Main, came to the conclusion that there was de facto no such thing as lottery addiction.
